Changed NR12 SAFETY OF MACHINERY AND EQUIPMENT Brazil Compliance Standards
Brazil Compliance Standards NR12. A change published in the Official Gazette of this Thursday (12), by the Ministry of Labor, establishes new rules for the inspection of Regulatory Norm 12 (NR 12). Work tax auditors will continue to inspect companies to see if the safety of the machines and equipment that NR 12 establishes is being observed. However, they will give time for business owners to adjust, before issuing notices of infraction and fines.
(Also in Portuguese) The amendment aims to meet the interests of protecting the health and safety of workers, in addition to conciliate with companies that have the true intention of regularization, giving them the opportunity for adequacy. At the same time, this change gives tax auditors greater autonomy during audits. “The main goal is to comply with the protection standard, providing companies with the opportunity to present technical and financial difficulties that pose obstacles to regularization, in order to jointly seek a solution that is appropriate to each case. The workers will not suffer any damage or threat to the new procedure, “said Maria Teresa Pacheco Jensen, Secretary of Labor Inspection at the Ministry of Labor. The inspector general of the Department of Occupational Safety and Health of the Ministry of Labor, Jeferson Seidler, explains that, before the tax audit of the work, when it detected an irregularity, immediately issued the notice of infraction, which would be converted into a fine after time of appeal. This was the procedure from the first visit to the company. “Now it notifies the company and gives it a deadline to adjust, without imposing a fine,” he says.
The entrepreneur will also be able to request an extension of time if he / she can not make the necessary adjustments within the time established by the supervision of the Ministry of Labor. The only exception is in cases where a serious and imminent risk to the worker is detected. “If the machine offers a high probability of serious injury to the worker, the machine will be immediately restrained,” adds Seidler.
This change will take effect for 36 months. This is the period in which the special procedure will be adopted by the Labor Inspection. The National Thematic Tripartite Commission of NR 12, made up of representatives of workers, employers and government, will monitor the law enforcement.
